Terms of Service

Welcome to RememberEvent. These Terms of Service ("Terms") govern your use of RememberEvent, including the website at rememberevent.com and the event photo gallery web application (collectively, the "Service"), operated by Nationwide Billing Group, LLC ("we," "us," or "our").

By creating a gallery, entering a gallery, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What RememberEvent Is

RememberEvent lets an event organizer or planner create a branded photo gallery for a single event. Guests join by scanning a QR code or link, typing a first name, and entering a shared event password — no app download and no account. Guests upload photos and can view, favorite, comment on, and download photos in that event's gallery.

2. Eligibility and Accounts

To create and pay for a gallery, you must be at least 18 years old and able to enter into these Terms. You are responsible for the confidentiality of your account credentials and for the shared gallery password you distribute.

Gallery guests do not create accounts; they enter a gallery using a first name and the shared event password. Guests may include minors. Minors may participate only under the supervision and responsibility of the event organizer and of the minors' parents or guardians (see Sections 4 and 7).

3. Organizer Responsibilities

If you create a gallery, you are responsible for your event and its gallery, and you agree to use the Service in compliance with applicable laws. In particular, you are responsible for:

  • Obtaining any consents required to collect, display, and share photos taken at your event, including photos of minors;
  • Only uploading a logo or branding you have the right to use;
  • How you and your guests use photos downloaded from the gallery; and
  • Distributing the shared gallery password responsibly.

We are not responsible for the conduct of organizers or guests, or for how photos are used after they are downloaded.

4. Guest Uploads and Content Ownership

Guests and organizers retain ownership of the photos and content they upload. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and distribute that content as necessary to operate the gallery (including generating resized and moderated versions). This license ends when the content is deleted, except for content we are legally required to preserve (see Sections 7 and 8).

You are solely responsible for the content you upload. Do not upload photos of other people without the consent needed for your event.

5. Acceptable Use

You agree not to:

  • Upload content that is illegal, obscene, sexually explicit, defamatory, harassing, or discriminatory;
  • Upload any child sexual abuse material (CSAM) — we have zero tolerance and report it as described in Section 7;
  • Upload photos of others without appropriate consent;
  • Attempt to gain unauthorized access to a gallery, account, or our systems;
  • Use automated tools, bots, or scrapers to access the Service; or
  • Interfere with or disrupt the Service or its infrastructure.

We may remove content, revoke gallery access, or suspend accounts that violate these Terms, at our discretion.

6. Branding and Logos

When you upload a logo for an event, you confirm you have the right to use it, and you grant us the license needed to display it and to derive a color theme for your gallery. You are responsible for any third-party rights in the branding you provide.

7. Moderation, Reporting, and Minors

Every uploaded photo is automatically screened before it appears in a gallery. Galleries default to a heightened moderation setting appropriate for events that include minors, and this setting remains elevated unless an organizer explicitly confirms an adults-only event. Any guest can report a photo, and organizers (and we) can remove any photo.

We use automated detection and reporting to identify illegal content, including CSAM. When we become aware of apparent CSAM, we are legally required to report it to the National Center for Missing & Exploited Children (NCMEC) and to preserve the related content and data. Reported or legally preserved content is not deleted on the normal schedule.

8. Photo Retention and Deletion

A gallery and its photos are retained for 30 days after the event and then permanently deleted, except for content we are required to preserve for legal or safety reasons. Do not rely on the Service as your only copy — download anything you want to keep before the deletion window ends.

9. Paid Plans and Payments

RememberEvent charges a flat price per event gallery, with a discounted multi-event pack. Current pricing is shown on our pricing page.

  • Single event: a flat one-time price for one event gallery, paid when the gallery is created.
  • Event packs: a multi-event pack is sold as a set of event credits at a discounted total. Pack credits are applied to your galleries by our team on request.

Payments are processed by Stripe; by purchasing, you also agree to Stripe's terms. All purchases are final; if you believe a charge was made in error, contact us within 14 days. We may change pricing at any time, but changes do not affect purchases you have already completed.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free, that moderation will catch every prohibited upload, or that photos will be recoverable after the deletion window.

12. Limitation of Liability

To the maximum extent permitted by law, Nationwide Billing Group, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data or photos. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $20, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Nationwide Billing Group, LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your uploaded content, your violation of these Terms, or your violation of any rights of another person — including any failure to obtain consents required for photos taken at your event.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Florida.
